payment terms and conditions

For your confidence and my own, I  have a few terms and payment arrangements to agree to before work commences.

The following rates and terms apply:

Anita Tibbertsma, also known as “Anita T”, trading under ABN 71 500 954 849 will provide me with the agreed deliverables, as briefed via https://anitat.com.au/briefme/ on behalf of the company.

This agreement is under the name detailed in the request, on behalf of the company detailed at https://anitat.com.au/briefme/ 

If a name submitted is inaccurate, the key contact of the company utilised in previous arrangements and defined in the original contractual arrangement will take onus over this agreement.

The contract will be in effect from the date of my brief submission on https://anitat.com.au/briefme/
A record of this brief will be distributed to both parties.

I agree to arrange payment per month on behalf of the company, for the engagement of Anita T’s services. This payment will be securely transferred via PayPal, credit card or another electronic payment processor as agreed to by both parties and detailed in invoices, no later than the 7th of the month, for work delivered and accepted in the previous month.

Anita T’s standard hourly rate is $100/hour + GST unless otherwise negotiated and confirmed in writing.

The scope of the project has been detailed at anitat.com.au/briefme. It’s this brief you submit that details the agreed on project deliverables.

The price at the beginning of this contractual arrangement is based on the time investment Anita T estimated is needed to fulfil the brief. If additional time or resources as required, you will be billed accordingly at the standard hourly rate – $100/hour + GST.

Sign-off is required in writing before a project goes live or to print. This can be an email, a text, slack message, or any other tool used in common to communicate in print, as long as there is a record of approval. Whilst Anita T will do all she can to ensure work is error-free, it is the dual responsibility of the client to vet and check for errors and notify Anita T of changes before a project goes to print and/or live.

Anita T will invoice you and/or your accounts department on the last business day of each month, for the agreed deliverables accepted that month and briefed on site. Payments will be fulfiled no later than 30 days, for work delivered and accepted in the previous month.

Should we come to the unfortunate situation that either party chooses to discontinue work, only hours spent thus far will be pro-rated and billed, and over-payments refunded.

There is no 30-day clause. I want to be of genuine service, and I don’t want to lock-in unhappy customers.

There is an interest fee of 10% placed on late payments. This is because I can’t stay in business without pay and like you, I don’t want to starve.

Anita T cannot guarantee that her work will be completely error-free, although she will endeavour to make it so. As such Anita T cannot be held liable to you or any third-party for damages, including lost profits, lost savings, or other incidental, consequential or special damages, even if you’ve advised Anita T of them. If any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.

As the client, you will own the copyright for material created under this agreement. I do occasionally profile previews r samples of work I have completed for clients in my portfolio, with any information that has not been open to the public, blurred. The portfolio showcase may include details around results.
